Functional Genomics Institute

The following terms and conditions apply in addition to our Privacy Policy, Disclaimer, and General Terms of Use.

These Terms and Conditions may be amended by written negotiation between us. It is sufficient for a variation to be contained in an email exchange where we each express clear consent to the proposed changes.

Your purchase of the Functional Genomics Institute membership subscription constitutes your agreement to these Terms and Conditions in their entirety. 

Subscription

Your access to the Functional Genomics Institute operates via a membership subscription:

• Standard Membership
  • recurring monthly subscription
  • recurring annual subscription
• Premium Membership
  • recurring annual subscription (reduced fees apply from year 2 onwards)

We do not offer different membership rates for students or financial hardship at this time.

Subscription Terms

1. Subscription is payable by card via Stripe Payment Gateway at our online checkout only. We do not accept cash or bank transfer for membership subscriptions. 
2. An additional 10% GST applies to all subscriptions for Australian residents.
3. Failure to pay your membership subscription fees on-time will result in automatic cancellation of your access.

5. By signing up to the Functional Genomics Institute you hereby agree to pay the indicated subscription fee upon checkout with a minimum commitment period of 3 months.
6. The Functional Genomics Institute is only offered to practitioners and practitioner students over the age of 18.  

Minimum Commitment Period 

You agree to commit to a 3-month initial period membership of the Functional Genomics Institute followed by an automatic renewal in alignment with your subscription selection (monthly or annually).

In consideration of You agreeing to the Minimum Commitment Period and subscribing to the Functional Genomics Institute, MTHFR Support Australia agrees to provide you with the benefits set out below:

• Free and unlimited access to resources included in your Functional Genomics Institute subscription for the duration of your subscription. Note that resources differ between standard membership and premium membership.
  
• Access to attend the quarterly live session with a MTHFR Support Australia practitioner for the lifetime of your subscription. These sessions are held online via Zoom.
• Access to Functional Genomics Institute member exclusive promotions, discounts and events.
• Technical support in relation to accessing your benefits.

Accessing Membership Benefits

1. Access to the Functional Genomics Institute and associated member benefits is via an online website or the Simplero App. Therefore, internet access is required to fully experience everything the membership has to offer.
2. Training videos, audios and slidedecks are not downloadable, they are only available to you to view in the online Institute member portal.
3. Member perks, events and bonuses will be available from time-to-time in the online portal and via email notification. It is your responsibility to check for such notifications. We highly recommend ensuring your email subscription remains active (not unsubscribed) so that you can receive email communications from us about the Institute, upcoming member events, and upcoming or additional Member perks. 
4. Only the registered member may access the Membership website and associated membership benefits.  Sharing your login and/or sharing access to member-only content, resources or benefits will result in immediate cancellation of your membership without refund or re-entry options. 

Cancellation & Termination:

1. Should you wish to cancel your subscription, you are required to give us 7 days notice in writing via e-mail at admin@mthfrsupport.com.au.
2. When you cancel your subscription, your account will remain active for any days remaining in your pre-paid subscription. Refunds for early cancellation is not offered. 
3. Due to the digital nature of membership benefits, any unused benefits are non-refundable.
4. Upon cancellation of membership, all access to the Functional Genomics Institute will be revoked. 
5. Any Minimum Commitment Period Benefits that may have been accumulated in accordance with these Terms will be forfeited immediately upon termination of your subscription.

Copyright and Trademark Infringement

1. MTHFR Support Australia owns all content hosted and provided inside the Functional Genomics Institute, unless indicated otherwise.
2. The Institute provides you with access to information and resources which are not in the public domain. You must not discuss or disclose such confidential information to anyone not directly involved in the Institute.
3. Membership content and resources are provided to you for your personal use in connection with your work as a practitioner or for your own general interest. Under NO circumstances are you allowed to sell or promote Institute content without written permission from MTHFR Support Australia. 
4. Any unauthorised use of any portion of the content, will be an infringement of copyright and trademarks. 
5. Unauthorised use of copyright material will be met with legal action.
6. All Users agree that they will be liable for compensation for all unauthorised use.

Guarantees

MTHFR Support Australia do not offer any guarantee of results as outcomes are dependent on a wide range of factors outside of our knowledge or control.

Indemnity

You agree to indemnify, defend, hold harmless, release and absolve MTHFR Support Australia and our practitioners from all liability, in all reasonable respects.

Our suggestions and guidance only ever provide you with options for your consideration. You are solely responsible for the choices that you make, so it is important that you stand in your power, conduct your own research, seek professional advice if you have concerns and make informed decisions about what is right for you in your individual circumstances at this time in your journey.

You understand and agree that your participation in every part of the Functional Genomics Institute is undertaken of your own free will and desire to participate and you agree to accept full responsibility should anything happen to you, physically, mentally, emotionally or financially under such circumstances. 

You waive any claims to compensation to the full extent that might be permitted by law. 

Limitation of Liability

You expressly agree that the total cumulative liability for all causes of action of any kind shall not exceed the amount that you paid for your participation in the Functional Genomics Institute.
